1. Acceptance of Terms

By accessing or using Pascend ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Pascend is an AI-powered trading card game platform that allows users to:

• Generate unique trading cards using artificial intelligence
• Build and customize card decks
• Engage in strategic turn-based battles with other players
• Trade cards with other users through our marketplace
• Purchase tokens to generate premium tradeable cards
• Participate in ranked competitive play

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You may register using your email address or through third-party authentication providers (Google). You must provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

3.3 Account Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

4. Token System and Payments

4.1 Token Packages

Pascend offers the following token packages for purchase:

• Starter Pack: 5 tokens for $5.00 ($1.00 per token)
• Power Pack: 10 tokens for $9.00 ($0.90 per token)
• Pro Pack: 20 tokens for $15.00 ($0.75 per token)
• Legendary Pack: 50 tokens for $35.00 ($0.70 per token)

4.2 Token Usage

• Each token generates 3 unique card options - you choose your favorite
• New users receive 10 free tokens upon account creation
• Cards generated with free tokens cannot be traded
• Each trade transaction requires a 1-token fee
• Tokens are non-refundable and non-transferable

4.3 Payment Processing

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. We do not store your payment information on our servers.

4.4 Refund Policy

All token purchases are final and non-refundable. Tokens have no cash value and cannot be exchanged for money. In exceptional circumstances involving technical errors, we may provide refunds at our sole discretion.

5. AI-Generated Content and Intellectual Property

5.1 Card Generation

When you provide prompts for card generation, our AI system creates unique artwork and content. By using this feature, you acknowledge that:

• Generated content is created by AI based on your prompts
• You do not own copyright to AI-generated artwork
• Generated cards become part of the Pascend game ecosystem
• We reserve the right to use generated content for service improvement

5.2 User-Generated Content

You retain ownership of text prompts and descriptions you provide. However, by using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your prompts for the purpose of generating cards and operating the Service.

5.3 Prohibited Content

You may not create or attempt to generate content that is:

• Illegal, harmful, or violates any laws
• Hateful, discriminatory, or promotes violence
• Sexually explicit or inappropriate
• Infringes on third-party intellectual property rights
• Contains personal information of others
• Spam or misleading content

6. Trading and Marketplace

6.1 Trading Eligibility

Only cards generated with purchased tokens are eligible for trading. Cards generated with free tokens cannot be traded or sold.

6.2 Trading Rules

• All trades are conducted using tokens as currency
• Each trade transaction incurs a 1-token fee
• Listing prices must be between 1 and 1,000 tokens
• All trades are final and cannot be reversed
• We do not guarantee the value or desirability of any cards

6.3 Marketplace Conduct

Users must conduct themselves fairly and honestly in all trading activities. Manipulation, fraud, or exploitation of the trading system is strictly prohibited and may result in account termination.

7. Gameplay and Competition

7.1 Fair Play

All users must engage in fair play. The following are prohibited:

• Cheating, hacking, or exploiting game mechanics
• Using automated tools or bots
• Colluding with other players to manipulate rankings
• Harassment or unsportsmanlike conduct

7.2 Rankings and Leaderboards

Rankings are based on gameplay performance and are updated regularly. We reserve the right to adjust rankings if we detect violations of fair play policies.

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection and use of your information.

9. Prohibited Uses

You may not use the Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To spam, phish, pharm, pretext, spider, crawl, or scrape
• For any obscene or immoral purpose
• To interfere with or circumvent the security features of the Service

10. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

11. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT

12. Limitation of Liability

IN NO EVENT SHALL PASCEND, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

13. Indemnification

You agree to defend, indemnify, and hold harmless Pascend and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

14. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which Pascend operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. Continued use of the Service after changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
